Clever Web Solutions - Terms and Conditions

All services that we provide are subject to the following terms and conditions. These policies have been put into place to protect both my clients and myself.

If you do not agree with any element of our Terms of Service, please do not contact us for a quote for services. By hiring us to work on your project, you are agreeing to the terms of service as written below.

Our Guarantee to You

I guarantee to you that every website and ecommerce store I develop will be fully operational and working without glitches, bugs or other errors upon delivery.

If your site or ecommerce programming has been edited by anyone other than myself, this guarantee is then voided, and charges for editing the site will be applied at our hourly rate.

I will always advise you of and seek permission for changes to your website and the charges that will be applied before any work is completed.

Quotes & Contracts

Quotes provided to prospects will be honored for 30 days. A new quote will then be provided upon request. Contracts that have been written, but not signed by the client will only be accepted within 30 days of the delivery date. A new contract may be drawn up upon request.

Final payment is due upon completion of service. Any check payments that do not clear will be charged a $35 fee.

Charges & Fees

I require a 50% non-refundable deposit in order to begin work on any web design project, with the remaining balance due when the project is complete, but before it goes live.

For web design projects:

You will receive an invoice for the 50% deposit after Phase I of the Design Process. These up-front charges will pay for set-up fees such as domain name registration, web site hosting, ssl license (if applicable), and any other setup fees or service.

You will receive a 2nd invoice once the client has approved the project. The website will be uploaded to the hosting server once payment of the remaining 50% of the proposal has been received.

For graphic design projects (corporate identity projects):

My logo design process begins with a needs analysis and initial consultation. We will then provide a proof sheet with 4 custom designs (logos, business cards, letterheads, and envelopes) to choose from. You will receive an invoice for the full price of the service upon approval. Delivery of the graphics will be made upon delivery of the paid invoice.

Graphics will be delivered via email. You will be supplied a hyperlink inside of the email that will enable you to download your files.

If you would rather a CD containing the files be delivered to your residence I will mail your files via media mail free of charge to my clients

For site maintenance:

You have a 30-day period after the site is launched in which content updates and any other technical problems that may arise with the site are free of charge. On the 31st day after website launch all web site maintenance fees are charged at a rate of $20 per hour.

Maintenance plans include:

Pay-as-you-go - $35 per hour: Includes content/image updates per month. This plan is for those that only have a handful of updates that need to be made each month. Most content updates can be completed within an hour.

Monthly - $200 per month: Includes site backups and content/image updates per month. This plan is for those that have a considerable amount of updates such as product changes, pricing changes, and information updates. Most content updates can be completed within an hour.

All text updates must be delivered in either MS Word format or via email. Pictures must be provided in electronic format via disc or email. Picture scanning and word processing services included in the maintenance programs at an additional cost.

Web Site Design Credit

I take great pride in every custom website I create. Therefore, I require that our Design by stamp with a link to our company website remain on our client's websites at all time. This link will appear at the very bottom of your website, and contain a small image () that will link to our website.

Copyright Policy

Copyright to designs and layouts that I create are not transferred to the client. I DO NOT CONDONE copying images, text or design layouts from other sites. I ask that you, my client, PLEASE only provide me with text, images and products that you own or have expressed written permission to use.

If you need a Web Content Writer for your project I offer this service, and will gladly write the content for you for a fee ($110 per page).

Under NO circumstances will I, my partners, or contracters be held liable for content provided by a client on a client website.

As the client, you will pay any and all legal expenses that are a result of lawsuit against me/Clever Web Solutions for graphics, images and/or content which is provided by and used by you the client.

Refunds

I require a deposit of 50% on all web design projects before I begin work on any project.

Please submit termination of services to us in writing. Should you request a termination of services after I have begun the process of creating your site, part of your deposit will be held as a a restocking fee. The amount of the refund will depend on the number of actual work hours put into the development of your project based at $30 per hour. Should the amount of time put into your project be greater than the deposit you have paid to me/Clever Web Solutions, you will be billed for the difference.

Non-payment of bills will result in collection activity against you, affecting your credit score and financial reputation.

In the event of a cancellation of contract, ownership of all artwork, layouts and development remain copyrighted to me/Clever Web Solutions and will not be transferred to the client.

Because we resell hosting for a larger company, we are unable to offer refunds on hosting, SSL and domain services. If you are dissatisfied with the hosting services provided, we will be happy to work out a solution with you that will meet your company needs. Please contact us to discuss your options.

Development & Delivery

I work extremely hard to complete all projects in a timely manner. I will provide you with an estimated time of delivery for your project. However, I do not guarantee deadlines as each project is unique and so is each customer.

I will communicate with you during the entire development of your project and provide you with status updates.

Smaller projects normally take 15-20 days to complete, but larger projects such as e-commerce sites could take upwards to a month or more based on the number of products the client may have.

Please understand that additional services, revisions to design or development of your site and delays in providing us with the information we require will significately add to the delivery time.

Non-Communication

If I am unable to communicate with a client on a project for a duration of at least thirty days (30) by phone or email during the design and development process, the project will be canceled without prior notice and no refund will be issued.

Project Consideration

Please note that Clever Web Solutions is a family-owned and operated company. Therefore, we will not accept projects that we find morally questionable, unethical, or distasteful. Website projects that require viewers to be 18 or older will not be accepted.

Acceptance

Please note that by submitting your downpayment for our services you are agreeing to all of our terms of service as written above. Clever Web Solutions reserves the right to change or update these terms at any time without prior notice.
